Terms of Service
Last updated: May 8, 2026These Terms of Service (“Terms”) govern your access to and use of RushDeck (the “Software”) and related services provided by Flavored Media GmbH (“Flavored Media”, “we”, “us”). By purchasing, downloading, installing, or using the Software, you agree to be bound by these Terms.

2. Payment Processing
Payments are processed by Paddle.com Market Limited, acting as the merchant of record (“Paddle”). Paddle is responsible for billing, tax collection, and remittance. Paddle’s terms apply to the payment transaction. The contractual relationship for license use is between you and Flavored Media GmbH.
3. Definitions
- Lifetime License: a perpetual, non-exclusive, non-transferable right to use the version of the Software available at the time of purchase, plus updates released during the first 12 months following purchase.
- Update Pass: an optional one-time purchase that extends access to feature updates by 12 months from the date of purchase. Multiple, non-consecutive Update Passes can be purchased over time. The Update Pass is not a subscription and does not auto-renew.
- Cloud Service: optional managed AI inference service (RushDeck Cloud AI), provided as a monthly or annual subscription with a defined monthly footage-analysis quota and per-minute overage pricing.
4. License Grant
Subject to your compliance with these Terms and payment of applicable fees, Flavored Media grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on up to two (2) Mac computers that you own or control, for your own commercial or personal use.
5. Restrictions
You may not:
- Resell, sublicense, rent, lease, lend, or otherwise transfer the Software or your license to any third party;
- Reverse engineer, decompile, or disassemble the Software, except where applicable law expressly permits;
- Remove, alter, or obscure any proprietary notices in the Software;
- Use the Software to develop a competing product;
- Use the Software in any way that violates applicable law.
6. Updates and Maintenance
The Lifetime License includes 12 months of free feature updates and security patches from the date of original purchase. After those 12 months, security patches addressing critical vulnerabilities will continue to be provided free of charge for a reasonable period.
Feature updates released after the initial 12-month window require a valid Update Pass. The Update Pass is a one-time purchase that extends feature-update access by 12 months from the date of purchase. It is not a subscription and does not auto-renew. You can purchase additional Update Passes at any time, with no requirement that the windows be consecutive — for example, you can skip a year and purchase a new Update Pass when a new macOS release requires a compatible RushDeck version. During an active Update Pass window, you receive all feature updates released in that window.
7. Cloud Service Subscriptions
The RushDeck Cloud AI subscription renews automatically until cancelled. You may cancel at any time via your Paddle customer portal, with cancellation taking effect at the end of the current billing period. 8. Refunds and Withdrawal
Customers in the European Union have a 14-day right of withdrawal under EU consumer protection law. Beyond statutory rights, we offer a 30-day money-back guarantee worldwide for the Lifetime License. See the Refund Policy for full conditions and how to request a refund.
9. Termination
We may suspend or terminate your license if you materially breach these Terms (in particular Section 5) and fail to remedy the breach within 14 days of written notice. You may terminate by ceasing use and uninstalling the Software at any time.
10. Disclaimer of Warranties
The Software is provided “as is” and “as available” without warranties of any kind, except as required by mandatory consumer law. We do not warrant that the Software will be uninterrupted, error-free, or compatible with all hardware or third-party services (including any NLEs, cloud storage providers, or AI providers).
11. Limitation of Liability
To the fullest extent permitted by applicable law, Flavored Media’s aggregate liability arising out of or relating to these Terms or the Software shall not exceed the amount you paid for the Software in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including loss of footage, project files, revenue, or data, except in cases of intent, gross negligence, or where mandatory law (including the German Product Liability Act) provides otherwise.
Customers are responsible for maintaining their own backups. RushDeck performs checksum-verified copying and crash recovery, but no software can fully replace independent backup procedures.
12. Data Protection
Our handling of personal data is described in the Privacy Policy. The desktop Software runs analysis on-device by default; no footage is transmitted to our servers unless you explicitly enable RushDeck AI Cloud or another opt-in cloud feature.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email to active customers at least 30 days before taking effect. Continued use of the Software after the effective date constitutes acceptance.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes with merchants, legal entities under public law, or special funds under public law is Augsburg, Germany. Mandatory consumer protection rights of customers domiciled in the EU remain unaffected.
15. EU Online Dispute Resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
